This Privacy Policy (Policy) outlines how we at "Open Eyes" collect, use, disclose, and safeguard your information when you interact with our OpenEyes Portal (Portal). We highly value your privacy and are committed to protecting the personal data (data) you share with us. Please take a moment to read through this policy carefully to understand our practices and how your information is handled.

Data controllers

If you are from Ukraine, the controller of your data will be the Charity Organization “Charity fund “Open Eyes”.

If you live outside of Ukraine, the controller of your data will be Fundacja Open Eyes Poland.

Personal data we collect

Personal information that we obtain directly from you

Donation form

By default, your donations will be anonymous. Only if you want your name to appear alongside the donation amount in the list of donators for the specific project should you specify your name in the respective field on the donation form. We rely on your consent as a legal basis when processing your name for the specified purpose. We will also ask your consent to send you marketing emails and will ask you to provide your email for the purpose.

Contact form

When you submit your request, inquiry or suggestion via contact form on our platform we will ask you to provide your full name and email address for the purpose of responding to and addressing the submitted requests or inquiries. This processing is necessary to pursue our legitimate interests, which are to fulfill our obligations and to provide the necessary information or assistance, to establish effective communication channels and to ensure a prompt and satisfactory response to an individual's inquiry or request.

Personal information about you we automatically collect

At the moment, on our Portal, we only use technologies and tools (services; including those provided by third parties) to ensure critical website functions (for example, online donation payment), and network and information security (for example, a firewall to filter malicious and potentially dangerous content and connections). The use of such services may involve the collection and processing of certain categories of personal data, such as: IP address, visited pages on our portal, information about your web browser (ID, version, operating system, screen extension, etc.). The processing of the above data is necessary for the purpose of protecting our legitimate interests, such as preventing fraudulent actions, unauthorized access or security breaches, protecting the network and systems from threats and vulnerabilities.

Personal information about you that we retrieve from third-party organizations

We do not retrieve any personal data about you from third-parties.

Use of cookies

We use first-party and third-party cookies to record user actions (such as accepting or consenting to the use of cookies) in a web browser and to enable and maintain security features of a user's session on this Portal.

About cookies

The term "Cookie" means small text files that are stored on the user's computer or device when visiting a website. Some of the cookies we use are automatically deleted when you close your browser (session cookies). Other cookies remain on your device and allow us or our partners to recognize your browser on your next visit (persistent cookies). It is important to note that cookies do not contain malware and cannot access other files on your computer or detect your email address.

We distinguish between technically necessary (essential), statistical, functional and marketing cookies. As you will not be able to use our website properly without essential cookies, they are always enabled. In the current version of the Portal, we do not install statistical, functional and marketing cookies.

Recipients of personal data

We may share your personal data with third-parties providing us with operational (such as payment services providers) and technology services (web hosting and security services providers) which may involve processing of personal data. We will only provide data that is relevant and necessary for the performance of the contract with such suppliers. Prior to transferring data for processing, contractual agreements are established with each supplier. These agreements govern the objectives and terms of personal data processing and outline a set of security measures and controls that the supplier must implement to ensure the reliable protection of your data throughout the entire processing duration.

Transfer of your personal data outside EEA/UK

Where permitted by law, we may transfer, store, process and/or deal with your personal data outside EEA/UK. In doing so, we will comply with all the applicable data protection and privacy laws.

Data Security

We endeavor to use appropriate technical and physical security measures to protect your personal data which is transmitted, stored or otherwise processed by us, from accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access.

Obligation to provide personal data

You are not required by law or contract to provide us with personal data. However, we cannot respond to your inquiry through the contact form unless you provide at least your email and name.

Duration of data storage

We keep your personal data for as long as it is necessary to do so to fulfil the purposes for which it was collected as described above. We may also retain and use your information in order to comply with our legal obligations, resolve disputes, prevent abuse.

Changes to this Policy

We reserve the right to change this Policy at any time in our sole discretion. You will be notified if we make changes to this Policy.

Automated individual decision-making, including profiling does not take place.

Your rights

You have the right to:

  • to know about the sources, the location of your personal data, the purpose of processing, the location or place of residence (residence) of the controller of personal data
  • receive information about the conditions for providing access to personal data, in particular information about third parties to whom your personal data is transferred
  • to access your personal data
  • obtain a copy of your personal data in an electronic format to receive no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, an answer about whether your personal data is being processed, as well as to receive the content of such personal data
  • withdraw your consent to the processing of personal data at any time, provided that your personal data is processed with your consent
  • submit a reasoned and justified request for the restriction, correction or deletion of your personal data if your personal data is inaccurate or if you consider the processing to be unlawful
  • lodge complaints regarding the processing of your personal data to the data controller, relevant personal data protection authorities or to the court
